The virus is spreading, and the cannazombies are still roaming the streets.
Even after the LB business department makes a joke of the lottery being held for the bull shit ordinance they wrote, tons of people dump their life savings into a permit application and upgrades in an attempt to get a license that may never exist, the ordinance gets changed…..changed and changed again, Long Beach gets sued, undercover officer walrus, City Attorney Barbie and Business License Ken all manage to over extend their job titles, Mr. Long Beach openly admits to being a money grubbing fraud and we have judgment passed on us by the cannabis hockey mom… we still feel as if there might be a sparkle of hope.
The frustration and abuse that have been endured by collective members from the city and the characters in the industry has rendered me speechless at times… which is hard to do. But now, I have dusted myself off and started over. Ready to let this bit of weight off my shoulders…..A letter to a few of the characters.
Dear Old man in the Sea
This story is about as unrealistic as a Hemmingway novel, I find it hard to believe that someone with a law degree can honestly make such blatant idiot of himself and the rest of the city so frequently. Its a wonder that the people of the council have taken your advice thus far....but then again, look at them. Just a clueless as the rest of you. At a point you have to wonder if its your age or your honestly just that lost as to where the real world is moving forward and some how are sitting in your position on your ass with little to no progressive movement.

Even though designer shoes and watch you wear are fake, the evil you represent as a person is very real. We see what your intentions are, the canna field wishes the scam you all pulled on the city would bring you and the rest of the nitwits you work with crashing and burning through the press telegram for your treachery and complete abuse of power. Where do I even begin? Im not positive what the prerequisites for being a politician are, but I think you should run a boot camp! You have managed to get the trust of the people, play nice for just long enough to get everyone in your grip and then choked the shit out of the people who thought you were on their side. Thank you for taking everything from so many hard working people….thank you for having no remorse and treating people who medicate with cannabis like society treats banged out heroin junkies on the side of the road. Stop faking the funk, you are not one of the "good people" in this industry! You are someone who got into this business because you saw someone else making a BUTT LOAD of money and thought "that looks easy, I dont have a job, maybe I should have my husband and his friends dump their life savings into this so that I can have a day job". How productive you have been (sarcastic tone)! Granted lady luck brought you the puzzle pieces that you needed to not be a CHAIN LINK, DIRT WEED, JOKE in this business but you will NEVER..... While being honest is noble and we appreciate the humor provided in most recent OC Weekly article there is a line between being ignorant and an idiot. Your arrogance and inability to distinguish between moments to delegate and moments to control has rendered your attempts at cannabis success to have been in vain. You have betrayed nearly every person within reaching distance and still managed to end up with nothing more than a remedial job working for a buddy slangin’ fish and steaks. Kudos.

The saga continues.....
Its been nearly a year since I last wrote regarding the ballyhoo that is going on in Long Beach.... but I must say the shit show that is Long Beach city council has at the very least earned style points. In my next few entries I will play by play the ridiculousness that I have suffered through in the past 11 months.

Im only laughing because Im medicated.
It took me almost a week to post, and I am sorry that it took me this long, but the shock has kept me from being able to find the words.........
THEY SCREWED US. Well.... not everyone, and not to our faces but indirectly with a sick attempt to use "public safety" as their scape goat the city of Long Beach has found a way to single out a select few collectives. Its apparent that Gerrie Schipske, Patrick O'Donnell and Gary DeLong all feel that their neighborhoods are to good for medical cannabis.
Some things are just too good to be true... The city made us believe that they wanted to work with us. But Pat O'Donnell wants to "see raids" in his exact words on the collectives that are no following their completely unethical, unconstitutional, unfair ordinance.
The city just thinks that we are going to roll over and take their abuse. There is no way that this is the end. Long Beach and the clowns that run it....
Im pretty sure that was the punch line.... but no one is laughing. The Long Beach city council has made a joke of the Medical Cannabis industry.
First they draft several completely unconstitutional ordinances, which basically spit in the faces of the California Voters. There were several different taxing plans brought up, even more zoning options and about 4 or 5 drafts of a completely ridiculous ordinance. The people speak out against the ordinance, the city votes, section 5.87 gets added to the Long Beach municipal code. While the ordinance was flawed the industry took it. I think that is where we went wrong. We allowed ourselves to be pushed to begin with.... We should have stood our ground. We shouldn't have let them take advantage of us from jump...
Last Tuesday there was a 5 to 4 vote to amend the ordinance. The four council members that voted against this all voiced their opinion about how unfair and unethical this amendment was; however, the vote proceeded. I was actually saddened by Robert Garcia.... I really thought a lot more of that council member and would have thought the voice of reason existed in his head.... but alas, again I fall disappointed.
So now is when the punch line comes in. All collectives that are not permitted are in violation of the Long Beach 5.87 ordinance, but NONE of the collectives are permitted. The city wont give permits because the ordinance has been constantly changing. And now the city gets to have a 45 day review period before any collective can receive their permits so that they can "determine your legitimacy". WHAT THE FUCK DOES THAT MEAN? They think we are all mongrels anyways... they assume that we are all gangsters with fat pockets. What they don’t realize is that we are all just regular people, who live in and somehow still love Long Beach…. Until the enforcement.

Politicians are interested in people. Not that this is always a virtue. Fleas are interested in dogs.
If we would have known this was the direction things were going, and that this was how the city was going to handle our industry.... would we all do it again?
This question was posed to me recently, and to be truthful I think I would consider cheating, lying, stealing and deceit as such facets in this struggle between politics and people that I'm not sure I see a real ability to be successful both in business and in spirit. So the question they were really asking me is....."If I knew you would have to sacrifice my morals to be able to be succeed with ease, would I?". The part that startles me... is I don't really have an answer.
Since I last wrote a lot has happened...
Council met: The people spoke before closed session and we begged that the city please not change the law on us again. We explained our positions and it fell on deaf ears. The council went back behind closed doors and made deals. Im sure they haggled like professional Tijuana street market shoppers. And when they walked out, deals had already been made, all favors called in. At the end of the day we are only really aware of one thing: the 3rd, 4th, and 5th districts had targets and would settle with anything that would let them hit their mark. And as it turns out, all they really needed was a 1000 ft buffer zone around parks too. They got it!
We walk away yet again, feeling violated and dejected. Unsure of how to move forward and fairly confused as to exactly what took place.
The following day we realize that not only did they amend the law in such a way that they were able to close 9 locations, BUT they also left out the possibility of relocation to the affected collectives. For days we were assuming that to be a mistake.... but upon further investigation, might have been just another tactic to sick game they are playing.
So now we wait for yet another Tuesday night, to walk into the lion’s den and watch the circus.... Long Beach has an excellent ring leader.... there is also a bearded lady, a leprechaun, a couple two headed snakes, a dancing monkey.... and then a few people with real talent somehow being out shined by the freaks....

The only problem with being too frustrated to involve yourself in politics is being governed by idots....
Yesterday was just another example of the intolerance a few of the council members here in Long Beach have. Its always a gamble when you walk in to the council chambers on on any given Tuesday. And its almost disgusting the way that some council members treat their constituents that have an opposing view of them. Below are the amendments that the Gerrie Schipske, Gary DeLong, and Patrick O'Donnell presented at last nights meeting along with my point of view on said amendments. 1. Collectives cannot be located within 1,000 feet of a Park, Library, or DayCare facility as licensed through the City of long Beach.
**** Nearly ¾ of the collectives would be affected and millions in law suits would come from business owners for loss in rent, utilities, time, and permit fees. And it seems unfair that due to others complacency to politics the past year when this law was being formulated (and remember this was on the FRONT page of the press telegram at least 5 times in the past year) and the feeling that somehow their neighborhood is any better than another neighborhood FINALLY deciding to come out and fight it because now they realize.... “oh wait, this might affect me too” And now those of us involved would be punished for trying to abide by the laws and regulations that the city put in front of us.
2. Limit the number of dispensary locations to 18 citywide, and no more than 2 dispensaries per district.
**** REFUND EVERYONE and START OVER. ALL $700,000+ (Councilman Delong stated that the city would refund anyone who made it through the lottery and was affected by this, but realistically and legally the people who did not make it through the lottery or even make it to the lottery that paid the permit fee should be refunded if in fact they potentially would have been affected by the new zoning. Really why would someone pay rent on a location regardless to if they made it past the lotto or not if it was in an unpermitted zone.
**** Potential Yearly Revenue of $370,000 to $1,080,000 per year in fees Down to 180,000 to $540,000
3. Restrict the cultivation of Medical Marijuana to Industrial Zones.
**** So in having 18 collectives and requiring all collectives to cultivate in industrial zones will there be 18 cultivation locations as well?
**** And how will we fit them into the 3 major industrial zones located in the west side being shared by the 1st and 2nd districts and in the Airport area in the 5th District and a sliver in the 9th district. ALL CULTIVATION WOULD BE LIMITED TO THOSE 4 DISTRICTS?!?
**** The new restrictions make it nearly impossible to exist, which I am beginning to wonder if that is the intention of the council members presenting this revision.
4. Require the collectives to produce Audited Financial Statements by a Certified Public Accountant (CPA) and submit their annual Sales Tax report for the Board of Equalization.
**** I do not see any problem with this request and I am sure all collectives would be okay to comply.
5. Restrict hours of operation to Monday through Sunday 9:00am to 5:00pm
****So only people who don’t have jobs can obtain their medicines in long beach during the week? “Im sorry sir you have cancer and have a job…. You have to wait until Sunday to get your medicine when you have a day off!”
6. In lieu of a Public Hearing provide a 45-day input/comment period while allowing the public to review submitted applications. Include an additional noticing to property owners once a permit is issued.
****I am not sure why this was changed, but if that makes more sense financially to the city then so be it.
7. Upon implementation of the amended ordinance, create a 1-year moratorium banning additional applications and request City Departments to come back and provide a report to City Council of effectiveness, impacts, and cost implications of implemented ordinance.
****If that is how long it takes to sort things out than that makes perfect sense. Im sure all collectives would be willing to abide by this.

**** Isn’t that already the case? Camera and centrally monitored security system and If not I am sure all collective owners city wide would be willing to participate in such an amendment.

Its like blowing smoke up my ........

The plot thickens.....
Last week Gerrie Schipske, Gary DeLong and Patrick O'Donnell proposed that the current standing Long Beach Municipal Code Chapter 5.87 should be amended and have added to it a 1000 foot buffer zone for all parks, libraries and child care facilities on top of the already existing 1000 foot buffer for all kindergarten through eighth grade and a 1500 foot buffer zone for all high schools in the long beach area.
This amendment would also add a limit of 2 collectives per district (18 total) even though the lottery that everyone agreed to participate in already chose 34 collectives.
And according to the 5th district council woman Gerrie Schipske “it wasn't clear in the ordinance” that the cannabis was going to be grown in areas that were being applied (ie: commercial and retail space) so now they want to restrict all growing to industrial zones only within Long Beach. But somehow 6 months ago when they were insisting that “all collectives must produce all their own medicines” and Tonia Uranga said “I don’t want my neighborhood to have large grow warehouses in bixby knolls” and the city council ignored her and passed this portion anyways, they didn’t see that this was going to happen?
SO….. would we have another lottery? Is the city going to return all several hundred thousand dollars to ANY AND ALL applicants that would have been affected by the changes they want to be made? Is the city prepared for all of the legal ramifications that are going to follow if they do pass this amendment?

Measure B did pass but due to 19's failure is null and void...
So now we wait for November 9th..... yet another vote.

Luck is what happens when preparation meets opportunity

City Raked in $703,401+ in APPLICATION FEES ALONE!!!
It was 3:00pm Monday afternoon when the most expensive lottery in Long Beach history took place in the council chambers. They didn't use either of the lottery machines they brought down... because for some reason the balls wouldn't fit through the machine.... apparently they didnt test the machines with the balls they were using before they brought them down. So they improvised, Annie (Eric Sund's Assistant) to the rescue with a..... RECYCLE BIN? Well it worked... but it was slightly amusing that after 40 accepted applications and a total of $703,401, not to mention the numerious applications that were denied AFTER they city took their $14,742 that we didn't have the resources to have a machine that worked.....
49 Locations went in to the lottery 11 were not accepted and of the remaining 39 Locations there are a total of 32 Collectives Still in the permit process.

City Raked in $703,401+ in APPLICATION FEES ALONE!!!
It was 3:00pm Monday afternoon when the most expensive lottery in Long Beach history took place in the council chambers. They didn't use either of the lottery machines they brought down... because for some reason the balls wouldn't fit through the machine.... apparently they didnt test the machines with the balls they were using before they brought them down. So they improvised, Annie (Eric Sund's Assistant) to the rescue with a..... RECYCLE BIN? Well it worked... but it was slightly amusing that after 40 accepted applications and a total of $703,401, not to mention the numerious applications that were denied AFTER they city took their $14,742 that we didn't have the resources to have a machine that worked.....
49 Locations went in to the lottery 11 were not accepted and of the remaining 39 Locations there are a total of 32 Collectives Still in the permit process.

The Lottery.... you know its all a game.....
Tomorrow at 3:00pm, in the council chambers there will be a public lottery for the Medical Cannabis collective and cultivation locations. There are 43 locations and about 38 collectives going into the drawing and according to the Finance Department about 30 will come out of the lottery, and I wouldn't be surprised if only 20 made it through the inspection process and were permitted...
It’s a bit confusing and slightly unnerving that it’s already very apparent who is being given favors due to connections with the city or money or both.... Long Beach is in this business too.... Tomorrow, we will see how truly apparent that is...

Laws are like sausages, it is better not to see them being made.

I am beginning to wonder if there are any human beings downtown, or if common sense and logic has become a thing of the past. And at what point did the run around become an accepted method of communication from our local government? Is this ironic, humorous or slightly unreasonable and unfair? Here the scenario.....
The City of Long Beach is now willing to work with the Cannabis industry by devising a permit process now that they are in a bit of financial trouble, and by a bit of financial trouble I mean $19 million in current debt on top of a $8 million dollar settlement that the city has just awarded to a man who was convicted and served 24 years on a murder charge that he did not commit.....
The cannabis permit application process is closed, they accepted applications from June 3rd- 18th, collecting money along the way and have taken in some half a million dollars or more in permit application fees. And once permits are given will be laughing all the way to the bank with close to a million more. The cease operation date for Collectives Located outside of the perameters is coming in 2 weeks, and the Lottery to thin the numbers further is September 20th. The Ordinance states
5.87.020: Medical Marijuana Collective- PERMIT REQUIRED. No Medical Marijuana Collective, Management Member or Member shall carry on, maintain or conduct any Medical Marijuana Collective Related operations in the City without first obtaining a Medical Marijuana Collective Permit from the Department of Financial Management.
HOWEVER, From what was said at City Council Meeting by Crystal Meyers and Eric Sund the city is going to allow people who are currently going through the permit process stay in business until they were either ruled null and void or given their permit. So just so long as you coughed up the $14,472 then you will be allowed at least another 3 weeks of operation before the city either pulls your ball.... or they dont.
And then you get your permit? NO.... think again!!!!!!!!
After that there will be another few weeks of public hearing, audits and inspections by what seems to be damn near every floor in City Hall... And after you jump through all of those hoops, THEN they will give you your permit to opperate as a medical cannabis collective.....
They only thing that doesn't make sense is that the Building and Planning Department in Long Beach isn’t going to allow any building permits to upgrade any buildings that is related to Medical Cannabis until the Collective Permits are given, but the Collective permits won’t be given until the entire building is retrofitted to be up to all of the ADA (Americans Disabilities Act) requirements. So the Financial Management People will tell you that you can’t get your Medical Marijuana Collective permits without the building being up to date but they won’t let you get your Building Permits to make it so without first obtaining your Medical Cannabis permits….. WTF?
Which direction are we really headed here?
And who the heck is driving?

LBC, you can have a stash..... but just not hash!
In 2003, California Attorney General Bill Lockyer issued a statement discussing the legality of concentrated cannabis. Opinion #03-411 the Attorney General states that concentrated cannabis or hashish is included within the term "marijuana" as it is used in the Compassionate Use Act.
In 2003, California's legislature passed SB 420 in an attempt to clear up the the Compassionate Use Act. California's SB 420, also known as the Medical Marijuana Program Act, went into effect January 1, 2004. While SB 420 has not prevented all harassment of patients by law enforcement, it has allowed for greater protection in the courts.
Somehow after all of this clarification from the Attorney General, when the City of Long Beach made their official ordinance they made sure to clarify differently.
Even though in the CUA, SB 420 AND the Long Beach Municipal Code 5.87 Marijuana is defined as "all parts of the plant Cannabis sativa L. weather growing or not; the seeds thereof; the resin extracted from any part of the plant; and every compound, manufacture, salt, derivative, mixture, or preparation of the plant, its seeds or resin."
The Long Beach ordinance also states in the Definitions 5.87.015 section B "Concentrated Cannabis shall have the same definition given such term in California Health and Safety Code Section 11006.5, as may be amended, and which defines "Concentrated Cannabis" as the separated resin, weather or purified, obtained from marijuana."
The ordinance goes on to state in the Prohibited Activity, Section 5.87.090 - G: "No manufacture of Concentrated Cannabis in violation of the California Health and Safety Code Section 11379.6 is allowed."
Okay.... so please allow for me to attempt to make sense of this.... The Federal Government Says that Hash is a HUGE deal, and a federal offense punishable by a 3-5 year prison sentence and/or a $50,000 fine.... BUT the California State Attorney General says that under the Compassionate Use Act and SB 420 it is allowed and considered medicine just the same as the dried flowers... AND THEN, the city of Long Beach even includes "the resin extracted from any part of the plant" in the definitions of "Marijuana" but amends that a few pages later to RECLASSIFY hash into the FEDERAL OFFENSE SECTION 1 DRUG code of 11379.6..... so be prepaired.... Long Beach says medically you can have a stash....its just better not be hash!

May 26th 2010 - NEW MAP PUT OUT!..... a few extra schools
June 1st-18th 2010 Application Submission
June 16th 2010 a NEW map is released....2 days before the application process is over.... whaaaat the F*CK ??? Is that even legal?!?!?

Its almost worse when they say nothing.....
So all is quiet on the western front and now we all just sit and wait, lucky for us cannabis is one of the best ways to pass the time....
All of the collectives within 1000 ft of a k-8 or 1500 ft of a high school in Long Beach have been served a cease and desist letters informing them all that they must pack up and move out of such a location by the 29th of August or else face a $1000 personal fine and or 12 months in jail.
Some collectives are under some strange impression that by suing the city for the rights of the Disabled is going to allow them to stay open and somehow surpasses the current Long Beach ordinance and the cease and desist letter from the city attorney...Mr. Robert Shannon himself.
Then there is the remaining few that decided to conform to stay alive, coughed up the fifteen or twenty five thousand to the city, and either we lucky enough to have been located in a good zone or found themselves a new location and swore under penalty of perjury that they would uphold the rules and regulations that Long Beach so painstakingly set before us. And then again we wait... until September 20th to hear who's lottery ball get pulled. Who gets to actually make something from this entire fiasco.

Only one day until the "window of opportunity" is closed for any 2010 applications for Medical Cannabis Collectives in the city of Long Beach. And all I know for sure is that the city has blindsided the industry and done its very best to put as many collectives and patients out.
Now we wait, to see the lawsuits and peaceful resistance that follow from this harmonious counter culture that is spreading faster than wild fire. And we see how many people actually conformed to this very particular permit process the city of Long Beach created.
